3.  Information Sharing and Disclosure

  • Service Providers & KYC Agencies: We share data with trusted third-party vendors (like payment processors, email servers, and authorized KYC Registration Agencies) strictly necessary to operate the platform and verify your identity.

  • Legal & Regulatory Authorities: As a SEBI-registered entity, Arka Dutta Gupta is legally obligated to disclose your personal information, KYC records, PAN details, subscription history, or communication logs to SEBI, law enforcement, or courts upon official request or audit.

4.  Data Retention (Statutory Requirement)

Our data retention practices are strictly governed by Indian regulatory and corporate laws. Depending on the nature of the data, your information is retained as follows:

  • SEBI Regulated Data (5 Years): Under Regulation 25 of the SEBI (Research Analysts) Regulations, 2014, the Research Analyst (Arka Dutta Gupta) is legally mandated to maintain client identity records (KYC/PAN), consent agreements, and communications for a minimum period of five (5) years.

  • Corporate Financial Records (8 Years): Under the Companies Act, 2013, Equisigma Research is required to retain financial transaction records, invoices, and books of accounts for a minimum period of eight (8) years.

Important Note: Even if you cancel your subscription or request account deletion from the Platform Provider, we must retain these statutory records to fulfill our regulatory obligations and cannot delete them before the respective 5-year or 8-year periods expire.

5.  Data Security

We implement industry-standard security measures, including SSL encryption and secure server hosting, to protect your personal information, KYC documents, and PAN details from unauthorized access, alteration, or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure.
